REPRESENTATIVE CASES

STATE CASES:

Alcoholic Beverage Law/"Dram Shop Act" (2009). Represented on appeal an individual restaurant proprietor who was charged in high-profile criminal prosecution when a guest at the bar became involved in an auto accident with multiple fatalities. After appeal, all convictions were reversed and the case dismissed in its entirety.

Grand Larceny (2009).  Representing an individual charged with embezzling over $100,000.00 from her employer.

Unlawful Surveillance (2009).  Representing an individual charged with filming a woman without her permission.

Murder (2009) - Representing an individual accused of shooting and killing an off-duty New York City Corrections Officer.

Reckless Endangerment (2009) - Representing an individual in prosecution arising from his much publicized climb of a New York City skyscraper. After lengthy negotiations with the District Attorney’s Office, the case resulted in a sentence of community service.

Disability Insurance/Worker's Compensation Fraud (2009) - Representing an individual charged with defrauding disability and worker's compensation providers.

Narcotics Possession (2009) - Represented an individual in multiple cases involving drug possession.  After lengthy negotiations with the District Attorney's Office, all cases resulted in adjournments in contemplation of dismissal.

Felony Vehicular Assault (2008) - Represented an individual charged with recklessly causing serious physical injuries to an on-duty police officer by driving under the influence of ambien and causing a head-on collision.  After the defense case, the judge dismissed the felony reckless assault and a jury later acquitted the client of misdemeanor negligent assault.

Possession with Intent to Distribute Narcotics/Bail Jumping/Immigration - Hudson County, NJ (2008) Represented a man facing mandatory deportation after pleading guilty to possession with intent to distribute cocaine in 1988 and subsequently jumping bail prior to being sentenced.  After lengthy negotiations with the Court and prosecutor, it was agreed that he would enter Pre-Trial Intervention which would ultimately result in his 20 year old conviction and the bail jumping charges being vacated.  He was thereafter released from Immigration custody on bail.

Forgery (2008)- Represented man charged with check forgery and illegally disposing of a body in a high profile Manhattan case.  District Attorney agreed to dismiss all charges.

Narcotics Possession (2008)- Represented man in Manhattan who had been indicted on a Class A-I narcotics possession.  Despite having jumped bail for nearly 20 years, we successfully moved for dismissal of all charges.

Grand Larceny/Falsifying Business Records/Money Laundering/Tax Fraud (2008) - Represented former CEO in multi-million dollar corporate fraud prosecution in Saratoga, New York initiated by New York State Department of Taxation & Finance. After lengthy plea negotiations, secured a dispostion that resulted in a sentence of probation.

Driving While Intoxicated - Nassau County (2007) Represented a woman charged with DWI with an Intoxilizer reading of .15 "insufficient Sample." After a week long jury trial, she was acquitted of both the DWI and the lesser included charge of Driving While Ability Impaired.

Enterprise Corruption (2007) Represented an individual charged with Enterprise Corruption in connection with a massive gambling ring.

Attempted Grand Larceny in the 1st Degree (2007) Represented the chauffeur of a well known celebrity accused of attempting to extort $2 million dollars from her.

Enterprise Corruption/Scheme to Defraud (2007) Represented a man alleged to have engaged in a scheme to defraud insurance companies in his practice of running physical therapy offices in Brooklyn and Manhattan.

Resisting Arrest/Obstructing Governmental Administration (2006) Represented Prominent anti-war activist whose son was killed in Iraq after she was arrested while attempting to deliver a peace petition to the United States Mission to the United Nations. After a week long trial she was acquitted of the crimes of resisting arrest and obstructing governmental administration and convicted of the violation of trespass.

Kidnapping/Sex Abuse (2006) New York, New York - Represented a man alleged to have gained entry into a woman’s Chelsea apartment by posing as a fireman and sexually abusing her for 13 hours.

Money Laundering/Promoting Prostitution (2006) New York, New York - Represented a man charged with setting up credit card accounts for New York City escort service.

Medicaid Fraud (2006) New York State - Represented two health providers in separate investigations of Medicaid fraud.

Prevailing Wage (2006) Suffolk County, New York - Represented national corporation for alleged violations of state prevailing wage laws.

Rape (2005) Nassau County, New York - Represented a New Jersey law enforcement officer alleged to have raped a woman he met at a bar. Client was acquitted by a jury.

Sodomy/Sex Abuse (2005) New York, New York - Represented a Catholic Priest alleged to have sodomized and sexually abused a young male parishioner. After lengthy negotiations with prosecutors, client pled guilty to attempted sodomy and was sentenced to probation.

Assault (2005) New York, New York - Represented woman arrested while protesting in Madison Square Garden during Republican National Convention who was alleged to have assaulted a security official. Client was acquitted by a a jury.

Murder (2005) Brooklyn, New York - Represented woman charged with murdering her autistic daughter by drowning her in a bathtub. Client was acquitted of Murder and convicted of the lesser offense of Manslaughter and sentenced to five years, the minimum time permitted by law.

Murder (2005) Queens, New York - Represented a young man charged with killing another young man with a samurai sword.

Trespass (2005) New York, New York - Represented demonstrators charged with trespass at a New York City armed services recruiting center. Client was acquitted by a judge.

Reckless Endangerment (2005) Suffolk County, New York - Represented a woman who was alleged to have aimed her SUV at a boy on his bicycle, forcing him to fall off his bicycle onto the side of the road. Client was acquitted by a judge.

Performing illegal marriages involving same-sex couples (2004) New Paltz, New York - Represented two Unitarian Universalist ministers charged with illegally solemnizing same sex marriages. Judge dismissed case on constitutional grounds.

Reckless Endangerment/Building Collapse (2003)- Represented an architect charged with reckless endangerment as a result of a partial building collapse in lower Manhattan. Jury acquitted on all felony charges and convicted of misdemeanor."   Jury acquitted on all felony charges and convicted of misdemeanor .

Grand Larceny (2003) Suffolk County, New York - Represented a financial lender charged with multi-million dollar fraud in connection with non traditional loans.

Vehicular Manslaughter (2003) Nassau County, New York - Represented high school student charged with manslaughter in connection with the death of her friend who was a passenger in her car. Client was acquitted by a jury.

Murder (2002) New York, New York - Represented a Madison Avenue landlord alleged to have shot and killed his tenant of 40 years.

Rape (2002) New York, New York - Represented a man alleged to have raped a woman in the elevator of his apartment building. Client was acquitted by a jury.

Capital Murder (1999) Suffolk County New York - Represented man charged with raping and murdering a female jogger.

Insurance Fraud (1998) Nassau County, New York - Represented a doctor charged with defrauding insurance companies in connection with orthopedic examinations. Client was acquitted by a jury.

Murder (1997) Delaware - Represented college student charged with killing her newborn baby. Prosecutor initially sought the death penalty, but after lengthy negotiations, client pled guilty and was sentenced to two years in prison.

Manslaughter (1997) - Suffolk County, New York - Represented a high school student charged with killing another young man while driving his car after an argument. Client was acquitted by a jury.

Murder (1990) Suffolk County, New York - Represented a son charged with murdering his parents.


FEDERAL CASES
:

Racketeering/Conspiracy to Commit Robbery (2008).  Represented an individual alleged to have operated a gambling business and also charged with conspiracy to commit robbery in connection with a large undercover organized crime investigation. After lengthy negotiations with the Government, the case resulted in a plea bargain and the client was sentenced to 5 years probation.

Mail Fraud/Wire Fraud/False Claims/False Statements - Southern District of Ohio (2009).  Representing a government contractor alleged to have provided incorrect and faulty parts to the Department of Defense and facing debarment by the Defense Logistics Agency. 

Investment Bank Investigation (2009), Representing a director of an investment bank in a wide-ranging, multidistrict investigation by Federal and State prosecutors of alleged financial, securities and accounting misconduct at one of the largest and most prominent investment banks in the world.

Conspiracy to Defraud the United States (2008)- Represented owner of medical equipment company in prosecution for conspiracy to violate United States trade embargos.  Over objection of United States Attorney seeking Guidelines sentence of 46-57 months imprisonment, judge sentenced client to a non-guideline sentence of 1 month imprisonment based on our United States v. Booker argument.

Bank Structuring (2008)- Represented owner of numerous gas stations and trucking company in multimillion dollar bank structuring indictment.  After filing motions and making a forensic accounting presentation to the United States Attorney, defendant was offered a plea to a B Misdemeanor and was sentenced to pay a $1500 fine.

Distribution of Child Pornography (2008)- Represented man charged with distribution of tens of thousands of illegal pornographic images.  Despite Federal Guideline range of nearly 18 years, successfully argued for mandatory minimum sentence of 5 years.

Mortgage Fraud/Bank Fraud (2008)- Representing person charged in multi-million dollar mortgage fraud conspiracy.

Murder for Hire (2007) Represented a man charged with conspiring to kill individuals for insurance proceeds.

False Statement to Government Official (2006) Southern District of New York - Represented a man charged with making a false statement to FBI agents in an organized crime investigation.

Money Laundering (2006) Eastern District of New York - Represented an individual charged with money laundering in connection with an alleged scheme to distribute stolen goods involving a state judge.

Fraud/Tax Offenses (2005) Eastern District of New York - Represented a man alleged to have committed various tax offenses relating to family owned drug treatment clinics. Client was sentenced to home confinement and probation.

Conspiracy to Import Narcotics (2004) Eastern District of New York - Represented Columbian woman charged in a conspiracy to import narcotics into the United States. After lengthy discussions with prosecutors, the Government dismissed all charges.

Possession of Child Pornography (2004) Eastern District of New York - Represented a man alleged to have been in possession of child pornography on his computer. After lengthy discussions with prosecutors, prosecution was deferred and subsequently dismissed.

Stock Fraud (2002) Southern District of New York - Represented stockbroker charged with conspiracy to manipulate stock prices.

Fraud (2001) Southern District of New York - Represented a woman alleged to have defrauded investors in connection with a scheme involving medium term notes.

Bank Structuring (1999) Southern District of New York - Represented woman charged with conspiracy to avoid filing required bank forms by breaking down deposits into amounts less than $10,000.00. Client was acquitted by a jury.

Trespass on Federal Property (1997) Fort Benning, Georgia - Represented a man arrested for trespassing at the School of the Americas in Fort Benning, Georgia.

Car Lease Fraud (1993) Southern District of New York - Represented president of car lease firm charged with defrauding leasing companies by submission of fraudulent financial documentation.
